This Privacy Policy explains how we collect, use, share, and protect information when you visit modernheirloombooks.com, contact us, subscribe to our communications, make a purchase through our online shop, or work with us on a personal history or other custom project.

Information We Collect

Information You Provide to Us

We may collect personal information that you voluntarily provide when you:

  • contact us or submit an inquiry;
  • request information about our services;
  • subscribe to our email communications;
  • purchase a product through our online shop;
  • enter into an agreement with us for services; or
  • otherwise communicate or work with us.

Depending on how you interact with MHB, this information may include your name, email address, telephone number, billing or shipping address, order details, and information related to a prospective or active project.

Online Purchases and Payments

When you purchase a product through our website, we collect information necessary to process and fulfill your order, which may include your name, email address, billing and shipping addresses, telephone number, and details about the products you purchase.

Our website and online shop are hosted by Squarespace, and we use Squarespace Payments as our payment solution. Squarespace Payments uses third-party service providers, including Stripe for payment-processing services and Sift for fraud monitoring and detection. These providers may receive and process personal information in accordance with their own privacy policies.

MHB does not directly store your complete credit or debit card number.

We may also share information necessary to fulfill your order with service providers that assist us with shipping, order fulfillment, and related services. These providers receive only the information reasonably necessary to perform those services.

Website and Usage Information

When you visit our website, certain information may be collected automatically. This can include information about your browser, device, IP address, pages visited, referring website, and how you interact with our site.

Squarespace provides website hosting and analytics services to us and may collect and process this information on our behalf.

Cookies and Similar Technologies

Our website uses cookies and similar technologies to operate properly and to help us understand how visitors use the site.

Some cookies are necessary for essential website functions, such as maintaining a shopping cart and completing checkout. Other cookies may be used for analytics and performance purposes, such as understanding website traffic and how visitors interact with different pages.

Where required, you may be given the opportunity to accept or decline nonessential cookies through our cookie banner. You may also control cookies through your browser settings, although disabling necessary cookies may affect certain website functions.

Third-party services integrated with our website may also use cookies or similar technologies according to their own privacy policies.

How We Use Your Information

We may use personal information to:

  • respond to inquiries and communicate with you;
  • provide information about our services;
  • develop, manage, and complete client projects;
  • process and fulfill online purchases;
  • provide order confirmations, shipping information, and other transactional communications;
  • maintain our business and financial records;
  • operate, secure, analyze, and improve our website and services;
  • send newsletters or other marketing communications when you have subscribed or otherwise agreed to receive them;
  • comply with applicable legal and regulatory obligations; and
  • protect the rights, property, and security of MHB, our clients, and others.

We do not sell your personal information.

Client Project Materials and Confidentiality

The nature of Modern Heirloom Books’ work means that clients may entrust us with highly personal materials in connection with a project. These may include interview recordings and transcripts, photographs, letters, documents, manuscripts, family histories, genealogical information, personal recollections, and other materials supplied by a client or created in the course of our work together.

We treat these materials as confidential and use them only as necessary to provide the services for which we have been engaged, to administer the project, and as otherwise authorized by the client.

We do not sell client project materials. We do not publish, publicly share, or use identifiable client project materials for advertising, marketing, portfolio, or promotional purposes without the client’s permission.

We may share project materials with trusted service providers or professional collaborators when reasonably necessary to complete a client’s project—for example, editors, designers, transcription services, printers, or other production partners. When we do so, we limit access to what is reasonably necessary for their role in the project and expect those working with confidential client materials to handle them appropriately.

Additional confidentiality, ownership, and usage provisions contained in an individual client’s agreement with MHB will also apply to that project. If the terms of a client agreement provide greater confidentiality protections for project materials, those terms will govern.

Email Communications

If you subscribe to our newsletter or other marketing communications, we may use your name and email address to send those communications.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the email. Unsubscribing from marketing communications will not prevent us from sending transactional or service-related communications, such as order confirmations, shipping notices, or communications necessary to an active client project.

How We Share Information

We do not sell personal information.

We may share information with trusted third-party service providers when reasonably necessary to operate our business and provide our services. These may include providers that assist with:

  • website hosting and e-commerce;
  • payment processing and fraud prevention;
  • shipping and fulfillment;
  • email communications;
  • website analytics;
  • accounting and business administration; and
  • professional and book-production services.

These providers may process information according to their own privacy policies and terms.

We may also disclose information when reasonably necessary to comply with applicable law, a court order, or other valid legal process; to protect our legal rights; or to protect the safety and security of our business, clients, customers, or others.

If MHB is involved in a merger, acquisition, sale, restructuring, or transfer of all or substantially all of its business or assets, information held by the business may be transferred as part of that transaction, subject to applicable law and confidentiality obligations.

Data Retention

We retain personal information for as long as reasonably necessary to provide our services, fulfill orders, maintain appropriate business and financial records, comply with legal obligations, resolve disputes, and enforce our agreements.

Because the nature and duration of our custom book projects vary, the period for which client project materials are retained may also vary. Retention or disposition of materials associated with a particular project may additionally be governed by the client’s agreement with MHB or by arrangements made with the client.

Data Security

We take reasonable administrative and technical measures to protect personal information and confidential client materials in our possession.

Our website, online store, and payment solution are provided through Squarespace. Squarespace Payments and its payment-processing providers maintain compliance with applicable payment-card industry security standards. No method of electronic transmission or storage can be guaranteed to be completely secure, and we therefore cannot guarantee absolute security.

Your Privacy Choices

You may contact us to ask about personal information that MHB holds about you or to request that we correct or delete that information.

We will honor applicable privacy rights and reasonable requests where possible. In some circumstances, we may need to retain certain information to comply with legal, accounting, contractual, or other legitimate business obligations.

You may unsubscribe from marketing communications at any time using the unsubscribe link provided in those communications.

You may also manage certain cookie preferences through our website’s cookie controls, where available, or through your browser settings.

Children’s Privacy

Our website and services are not directed to children under 13, and we do not knowingly collect personal information online directly from children under 13.

If we learn that a child under 13 has provided personal information through our website without appropriate parental or guardian consent, we will take reasonable steps to delete it.

This provision does not prevent a client from providing photographs, stories, family-history information, or other materials concerning family members, including children, as part of a commissioned family-history or personal-history project.

Links to Other Websites

Our website may contain links to websites or services operated by third parties. MHB is not responsible for the privacy practices, content, or security of third-party websites. We encourage you to review the privacy policies of websites you visit.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our business, website, services, technology, or applicable requirements.

When we make changes, we will update the “Last updated” date at the top of this page. Material changes may also be communicated through our website or by other appropriate means.
